The terms and conditions that regulate the use of “Mobile Self Care Application” Service

These are the terms and conditions that regulate the use of “Mobile Self Care Application” Service of ALBtelecom sh.a. with all respective menus.

These terms and conditions constitute a legal agreement between you as a user and ALBtelecom sh.a.

BY CLICKING ON “ACCEPT” BUTTON:

YOU AGREE TO ACT IN COMPLIANCE WITH THESE TERMS AND CONDITIONS AND YOU ACCEPT THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO OPERATE IN COMPLIANCE WITH THE TERMS AND CONDITIONS HEREIN!

IN CASE YOU DO NOT AGREE TO OPERATE IN COMPLIANCE WITH THE TERMS AND CONDITIONS HEREIN, THEN CLICK ON THE BUTTON “GO BACK”.

In case you do not agree to operate in compliance with the Terms and Conditions herein, there shall not exist any agreement between you and Albtelecom and Albtelecom shall not be responsible to provide Mobile Self Care Application Service or the Application with all respective menus included in it.

Albtelecom is entitled to amend one or several conditions and terms herein upon a reasonable notice, including publication of a new version for the Service.

You also agree that the continuous use of Service by you constitutes the acceptance of conditions and terms with respective amendments.

Upon acceptance of these terms and conditions, you are entitled to download and use the Mobile Self Care service Application.

The download and use of Mobile Self Care service Application together with ALBtelecom Special Menu shall be free of charge in itself, except the applicable fee for navigation and use of internet depending on the Wi-Fi, 3G or 4G access point.


Definitions

The following terms shall have the meanings ascribed as follows:

  • ALBTELECOM sh.a. (“ALBtelecom”) is a joint stock company, established under Albanian laws, with head office at: Autostrada Tiranë – Durrës, Km 7, Kashar, Tiranë, with VAT-ID NO: J61824053N.
  • Application“ means Self Care service Application downloaded by you through your handset from online stores (Google, Apple, Windows, and Blackberry). Links shall be displayed as well at Albtelecom website to direct the user to the above stores.
  • "You/ User" means the person that uses the Self Care Application Service and is a subscriber (postpaid, prepaid and/or hybrid) in Albtelecom mobile telephony network.
  • “Party” – User or ALBtelecom as per case.
  • “Parties” – User and Albtelecom
  • “Mobile Self Care ApplicationService means the service that enables Albtelecom mobile telephony network subscribers to download in real time the details of their account and invoice, monthly generation, invoices, services` status, use of their packages (phone calls, SMS, internet), and Support, Map, Payment by card (recharge and invoices), downloading of application in your handset without an extra payment and ALBtelecom SPECIAL service.
  • ALBtelecom Special Menu – consist of benefitting of benefits from associate third parties of ALBtelecom through dedicated ALBtelecom Special menu.
  • Beneficiary of Benefit is the person that presents the Code to sales points/counters of Benefit Provider/associate trader of ALBtelecom, which code could have been benefitted directly from ALBtelecom Special Menu or could have been transferred from the user having met the conditions published in ALBtelecom website albtelecom.al

The Rights of Use
Albtelecom grants non-exclusive rights to you to use the Application, Mobile Self Care Service, and ALBtelecom Special menu. ALBtelecom shall have no responsibility and obligation, and doesn`t grant licenses/rights for the use of Application, Mobile Self Care Service and ALBtelecom Special Menu in a non-Albtelecom network or card.

You can`t copy, amend, separate into parts or diffract the Application, Mobile Self Care Service and ALBtelecom Special Menu or their parts.

You can`t transfer, assign, grant by sublicense, or allocate or allow a third party to use the Application, Mobile Self Care Service and ALBtelecom Special Menu or any part of them. You agree not use the Application, Albtelecom Special Menu and Mobile Self Care Service or any part of it in violation of applicable laws and regulations and their amendments time after time.

You agree that the Application, Mobile Self Care Service and ALBtelecom Special Menu may not be usable due to their

non-compliance with your handset.

In order to use the Application, Albtelecom Special Menu and Mobile Self Care Service, firstly You should configure your handset to enable internet navigation. ALBtelecom shall not be responsible for wrong, inaccurate configuration or non-operation of internet service for cases of ALBtelecom out of control and responsibility.

In order to access ALBtelecom Special Menu, you should have met the conditions published in ALBtelecom website www.albtelecom.al

In order to obtain the Benefit upon the receipt of respective Code, you should show up to sales points/counters of Benefit Provider/Trader together with the Code.

You are entitled to transfer the Code of awarded Benefit to a third person without any extra cost to you. Referring to aforementioned, as per the meaning of this Agreement, the recipient of Benefit shall be the person presenting the respective valid beneficiary Code to sales points/counters of Benefit Provider/associate Trader of ALBtelecom.

You are aware that the used and/or expired Codes (the validity term of which has expired), doesn`t entitle you to obtain the respective Benefit.

Intellectual Property Rights

You shall not benefit Intellectual Property right or other rights related with it, including patents, designs, trademarks, and copyrights in relation with the content of Application, Mobile Self Care Service and ALBtelecom Special Menu.

The provision of Application, Mobile Self Care Service and ALBtelecom Special Menu by ALBtelecom does not imply the transfer of Intellectual Property rights owned by us or licensed providers regarding the Application, ALBtelecom Special Menu and Mobile Self Care Service, but simply the allowing of the use of Application, ALBtelecom Special Menu and Mobile Self Care Service consistent with the Conditions and Terms of Use of Application, Albtelecom Special Menu and Mobile Self Care Service

The use of Application, Albtelecom Special Menu and Mobile Self Care Service is protected by respective legislation in Intellectual Property field.

You can`t print, copy, reproduce, allocate, modify or duplicate in any other way, either in whole or in part, the software or other materials provided to you in relation with Application, Albtelecom Special Menu and Mobile Self Care Service without prior written approval of ALBtelecom.


Responsibility and rules of the use of Application, Service, ALBtelecom Special Menu

You are fully responsible for your actions related with all the actions that you perform, the content that you download and the way of use of Service, ALBtelecom Special Menu and Application, including the protection of password and its access from third parties.

In case you are 18 years or older, you shall be personally liable for your charges arising from the use of Application, Mobile Self Care Service and ALBtelecom Special Menu provided by ALBtelecom.


In case you are under 18 years old, you and your parents or your legal guardian shall be liable for your charges arising from the use of Application, ALBtelecom Special Menu and Mobile Self Care Service.

By using the Application, ALBtelecom Special Menu and Mobile Self Care Service, you undertake as follows:


Non-use of Application, ALBtelecom Special Menu and Mobile Self Care Service for commercial purposes. The Service is only for personal use of Albtelecom subscribers and can`t be used for commercial activities, except when being clearly approved in written in advance by ALBtelecom.

In case you want to get connected with ALBtelecom network, you agree: (i) not to reproduce the Application, ALBtelecom Special Menu and Mobile Self Care (ii) not to perform actions related with or that cause the display of disdainful or miss-information content about ALBtelecom.

You are aware and agree to provide us during registration procedure with your personal information for your phone number, full e-mail address and the password selected by the User, and Albtelecom shall collect information regarding your phone and the way of use of application/ service, that is necessary for functioning of application/service (e.g. language, device and statistics of use).

Albtelecom uses the collected information in order to provide the required service, support in case of any problem, maintenance, optimization and improvement of service performance. ALBtelecom maintains the collected information in secure way in ALBtelecom servers, in compliance with respective provisions of applicable legislation on personal data protection.


Albtelecom may send you communications (SMS and/or emails from the system), including but not being limited to registration confirmation, reminders for passwords, updates for service changes by including notices that we may send regarding service use by you.

Albtelecom is entitled to use your information for marketing purposes only if you have given your consent in this regard. By using this service and accepting these conditions, you accept the use of your above data by ALBtelecom. In case you don`t want the use of your information for marketing purposes, please contact consistent with “Customer Care Service” section.

Contact for personal data. You as a user, in capacity of personal data entity, are entitled to request access, correction and update to your data consistent with requirements of Law 9887, dated 10.3.2008 «On personal data protection», as amended. The request can be addressed to any ALBtelecom shop.

Exclusions of Guarantees and Limitation of Liability

To the fullest extent permitted by applicable law, the Application, ALBtelecom Special Menu and Mobile Self Care Service is provided to you "as it is" without any guarantee or other conditions regarding the Application, ALBtelecom Special Menu and Mobile Self Care Service by the licensed providers of the Application, ALBtelecom Special Menu and Mobile Self Care Service.

We or our licensed providers of the Application, ALBtelecom Special Menu and Mobile Self Care Service shall not be liable against you including but not limited to any: reimbursement, compensation, damage and/or loss due to the present or future loss of profits, loss of revenues, turnover of sales; loss of good name, loss or harm of reputation, loss of contracts or clients, loss of anticipated savings, loss or damages of data or programs or for any other whatsoever reasons, or indirect, particular, incidental or consequential damages whether arising in tort (including negligence), or because of the contract and even if we or our licensed providers of the Application, ALBtelecom Special Menu and Mobile Self Care Service have been informed about the possibility of such losses or damages.

Governing Law and Jurisdiction

These Conditions and Terms for the use of Application, for the use of the Application ALBtelecom Special Menu and Mobile Self Care Service shall be governed and construed under Albania law. In case of any conflict in this regard, the Parties shall be committed to resolve them by good understanding. Otherwise, the parties shall refer the case to Tirana District Juridical Court.
